1. Acceptance of Terms
By accessing or using the Fosti website at fosti.com (the "Site"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Site.
2. About Fosti
Fosti, Inc. ("Fosti," "we," "us," or "our") operates a white-label sales tax compliance platform for CPA firms managing multi-client, multi-state operations. Fosti is currently in closed beta with selected design partner firms. The Site is used to provide information about the platform and to accept demo requests and waitlist applications.
3. Use of the Site
You may use the Site for lawful purposes only. You agree not to:
- Attempt to gain unauthorized access to any part of our systems or infrastructure
- Scrape, crawl, or systematically harvest data from the Site without prior written permission
- Submit false, misleading, or fraudulent information through any form on the Site
- Use the Site in any manner that violates applicable local, state, national, or international law
- Transmit any malicious code, viruses, or disruptive content through the Site
4. Intellectual Property
All content on the Site - including text, graphics, logos, product names, and software - is owned by or licensed to Fosti, Inc. and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, or other proprietary materials without our prior written consent.
You may not copy, reproduce, distribute, or create derivative works from any Site content without our explicit written permission.
5. No Product Warranty
Fosti is currently available to closed beta partners. Features, pricing, and availability are subject to change as the platform evolves. Nothing on the Site constitutes a binding commitment that any specific feature will remain available in its current form.
The Site is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Fosti, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site.
Our total aggregate liability to you for any claim arising from your use of the Site shall not exceed one hundred U.S. dollars ($100).
7. Third-Party Links
The Site may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or accuracy of those sites. Accessing third-party links is at your own risk.
8. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in our Privacy Policy.
9. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date above and post the revised Terms on this page. Your continued use of the Site after any changes are posted constitutes your acceptance of the updated Terms. If a change is material, we will make reasonable efforts to notify you.
